General Terms and Conditions (GTC) of Beurer Europe GmbH for the Antelope Rental Subscription

1. Scope and Contracting Parties


These General Terms and Conditions (GTC) apply to all rental agreements between

(hereinafter “Lessor”)
and consumers residing in Germany (hereinafter “Lessee”). This offer is directed exclusively at consumers within the meaning of Section 13 BGB (German Civil Code). Business customers are excluded from this rental model.

The Lessor is a limited liability company under German law engaged in the production and distribution of products, including accessories and spare parts, in the field of “Health and Well-being.” Under the “Antelope” brand, the Lessor also distributes wireless electro-muscle stimulation products (hereinafter “EMS Products”), which achieve training effects through electrical muscle stimulation.

2. Subject Matter of the Contract


1. The Lessor provides the Lessee with one or more EMS products (e.g. Antelope Evolution EMS Suit or Antelope Tank Top) for use in exchange for payment a rental subscription.
The Lessee may be either a natural person or a legal entity (e.g. a company).

2. The use of the rented items is permitted for non-commercial purposes.
In the case of rental by a company, use is limited to internal purposes only (e.g. use by employees as part of health or fitness programs).

3. Transfer to third parties is generally prohibited.
In particular, it is not permitted to provide the rented item to third parties for consideration or an independent contractual relationship (in particular subletting, leasing, lending for a fee, or comparable models).

4. The digital services, in particular the Antelope Go app, are an integral part of the contract. Use requires a smartphone with at least iOS 15 or Android 8. The app must be installed and its use accepted.


3. Commencement and Duration of the Rental


1. The contract is concluded via online checkout once the customer has accepted the GTC, privacy policy, and cancellation policy, and payment has been received.

2. Delivery takes place immediately after the conclusion of the contract. The rental period begins on the day of delivery.

3. The minimum rental period is 3, 6, 12, or 24 months, selected at the time of contract conclusion. Ordinary termination during the minimum rental period is excluded.

4. After expiry of the minimum rental period, the contract is automatically extended by one month at a time unless terminated at least 14 days before the end of the term or ongoing rental. Termination must be in text form, e.g., by email to info@antelope.de or via the customer portal of Circuly.

5. In case of non-payment, the Lessee is obliged to return the products immediately at their own expense.


4. Payment Terms


1. Payment is made monthly using standard payment methods offered in the checkout. No additional costs are incurred for payment processing.

2. For 12- and 24-month contracts, the Lessee has the option, via a voluntary buyout option, to purchase the rented products. Rent already paid will be credited proportionally toward the purchase price. The purchase price is based on the price valid at the time of the offer. A maximum of 50% of rent already paid will be credited.

3. For 3- and 6-month contracts, the Lessee has the option, via a voluntary buyout option, to purchase new products. The purchase price is based on the price valid at the time of the offer. A maximum of 50% of rent already paid will be credited.


5. Obligations of the Lessee


1. Commercial services provided to third parties (in particular in the context of fitness, personal training, studio, or therapy services for a fee) is prohibited.

The Lessee undertakes to maintain the rented item regularly and to use it exclusively in accordance with the instructions. In particular, the rental item must at all times be properly cared for and maintained in accordance with the operating and maintenance instructions and the cleaning instructions provided by the Lessor, which are enclosed with the rental item and are also available in their most current version at this Link, and must be kept in a safe operating condition. This includes, in particular, cleaning the textile components in accordance with the washing instructions and cleaning the silicone electrodes exclusively with a damp cloth, without the use of cleaning agents, disinfectants, or solvents. The costs arising from such care and maintenance shall be borne by the Lessee.

2. The Lessee undertakes to report any malfunctions, damage, or unusual reactions during use without undue delay.

3. Use of the product requires prior inspection of the device before each application.

4. The Lessee may neither sublet the product nor otherwise make it available to third parties for independent use, nor pledge or sell it.
In the case of legal entities, use by their own employees shall not be considered an impermissible transfer, provided that no separate paid or contractual usage relationship exists with those employees.

5. Commercial services provided to third parties (in particular in the context of fitness, personal training, studio, or therapy services for a fee) is prohibited.


6. Ownership and Return


1. The rental item remains the property of the Lessor at all times.

2. After termination of the contract, the rental item including accessories (excluding consumables) must be returned within 5 working days, duly cleaned in accordance with Section 5(1) above, at the Lessor's expense. A shipping label will be provided.

3. The rental item must be returned in a condition consistent with contractual use. Normal signs of wear are not considered damage. In case of excessive wear, alterations, or damage, the Lessor reserves the right to charge repair or replacement costs. The rental item shall be deemed properly cleaned within the meaning of paragraph 2 above, in particular, if the textile components have been washed and/or are odor-neutral, and the electrodes and the booster are free of residue from training or contact agents. If the returned rental item does not meet these requirements, the Lessor may charge the Lessee for the costs necessary for cleaning, without prejudice to any further claims under this paragraph.


7. Liability


1. The Lessor is fully liable for damages resulting from injury to life, body, or health, as well as for intent or gross negligence.

2. In the event of minor negligent breaches of duty, liability is limited to foreseeable, typical contractual damages.


8. Withdrawal and Waiver


1. Consumers have a statutory right of withdrawal. The withdrawal policy is provided during checkout.

2. If the Lessee expressly agrees during checkout that the Lessor begins contract performance before the withdrawal period has expired, the right of withdrawal expires upon complete delivery.


9. Final Provisions

2. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

3. Place of performance and jurisdiction is Ulm.

4. The rental contract is offered exclusively within Germany.

5. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
